Early Notice and Public Review of a Proposed Activity in a Floodplain

To:  All interested Agencies, Groups, and Individuals

This is to give notice that the City of Kyle (City) has determined that the following proposed action under the HUD Community Development Block Grant Entitlement Program, is located in the floodplain, and the City will be identifying and evaluating practicable alternatives to locating the action within the floodplain and the potential impacts on the floodplain from the proposed action, as required by Executive Order 11988 and in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.  The proposed project location is:  

Project Locations:   Sidewalks on both sides of the following streets in the City of Kyle, Hays County, TX:

·     Brent Blvd, from IH 35 S to Philomena Drive (30.003091, -97.862922);

·     Churchill Downs, from Brent Blvd to cul-de-sac (30.002551, -97.863661);

·     Ruidoso Road, from Brent Blvd to cul-de-sac (30.002003, -97.863064);

·     Pimlico, from Brent Blvd to cul-de-sac (30.001432, -97.862435);

·     Lexington, from Brent Blvd to cul-de-sac (30.000897, -97.861836).

Description of the Proposed Project :  Replace existing curb ramps and sidewalks within the same footprint, to be ADA-compliant, and complete associated appurtenances.

The extent of the FFRMS floodplain was determined using the Freeboard Value Approach and FEMA mapping.  Approximately <0.50-acres of project activities will occur in the 500-Year Floodplain.  The beneficial values of the floodplain will not be adversely affected as the project will not change the topography and best management practices will be utilized during construction.  Elevation requirements will not apply to this non-critical action project.

There are three primary purposes for this notice. First, people who may be affected by activities in the floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts on the floodplain.  Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains it must inform those who may be put at greater or continued risk.

Aviso anticipado y revisión pública de una actividad propuesta en una zona inundable

Por medio del presente, se notifica que la Ciudad de Kyle (la Ciudad) ha determinado que la siguiente acción propuesta, en el marco del Programa de Subvenciones en Bloque para el Desarrollo Comunitario del HUD, se ubica en una zona inundable. La Ciudad identificará y evaluará alternativas viables para ubicar la acción dentro de dicha zona, así como los posibles impactos de la acción propuesta en la misma, según lo exige la Orden Ejecutiva 11988 y de conformidad con las regulaciones del HUD, específicamente en el Título 24 del Código de Regulaciones Federales (CFR), Sección 55.20, Subparte C: Procedimientos para la toma de decisiones sobre la gestión de zonas inundables y la protección de humedales. La ubicación propuesta del proyecto es:

Descripción del proyecto propuesto: Reemplazar las rampas de bordillo y aceras existentes dentro del mismo perímetro, para que cumplan con la Ley de Estadounidenses con Discapacidades (ADA), y completar los accesorios asociados.

La extensión de la llanura aluvial del FFRMS se determinó mediante el método del Valor de Borde Libre y la cartografía de FEMA. Aproximadamente menos de 0,50 acres de actividades del proyecto se ubicarán en la llanura aluvial de 500 años. Los beneficios de la llanura aluvial no se verán afectados negativamente, ya que el proyecto no modificará la topografía y se utilizarán las mejores prácticas de gestión durante la construcción. Los requisitos de elevación no se aplicarán a este proyecto de acción no crítica.

Este aviso tiene tres propósitos principales. Primero, las personas que puedan verse afectadas por las actividades en la llanura aluvial y quienes tengan interés en la protección del medio ambiente natural deben tener la oportunidad de expresar sus inquietudes y proporcionar información sobre estas áreas. Se anima a los participantes a proponer sitios alternativos fuera de la llanura aluvial, métodos alternativos para lograr el mismo propósito del proyecto y métodos para minimizar y mitigar los impactos en la llanura aluvial.  PY 2025 ANNUAL ACTION PLAN
 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)

The City of Kyle receives Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD). The City prepares an Annual Action Plan outlining how it will allocate funds for the upcoming program year. The total amount of grant funds available for Program Year 2025 (October 1, 2025 – September 30, 2026) is $277,869.

The City of Kyle is proposing a Substantial Amendment to its adopted PY 2025 Annual Action Plan. The originally approved project included first-time sewer line improvements in the Quail Ridge neighborhood. Following additional review of implementation timing, acquisition considerations, and current cost conditions, the City proposes reallocating PY 2025 CDBG funds toward public sidewalk improvements that will serve low- and moderate-income areas within the City of Kyle.

To begin the process of determining funding priorities and activities for this amendment, and to receive public comment, the City is hosting a public hearing. Public comments are welcome at any time during the official comment period to comply with HUD’s minimum 30-day requirement.

CDBG Program Background:
 The national objective of the CDBG program is to develop viable urban communities by providing decent housing, a suitable living environment, and expanding economic opportunities principally for low- to moderate-income persons. Not less than 70% of CDBG funds must be used for activities that benefit low- to moderate-income persons individually or through non-profit agencies or public improvements in low- to moderate-income neighborhoods.

The proposed amendment reallocates funds to public infrastructure improvements that enhance pedestrian safety, accessibility, and mobility in eligible low- to moderate-income areas.

The proposed Substantial Amendment will be available for public review at the following locations:
